2. General Terms and Conditions of Sale (Conditions Générales de Vente)
2.1 Scope and Acceptance
These General Terms and Conditions of Sale (CGV) govern all sales of fine art prints made through deaghanimagery.com between Déaghán Ó Dálaigh (hereinafter "the Seller") and any natural or legal person making a purchase (hereinafter "the Customer"). Any order placed on this website constitutes full and unconditional acceptance of these CGV.
2.2 Products
The products offered for sale are fine art giclée prints produced on Hahnemühle Photo Rag 308gsm paper. Products are available in limited and open editions as described on the individual product listings. Edition limits stated on the website are binding; once an edition is closed it will not be reprinted at that size. All prints are made to order. The Seller reserves the right to withdraw any product from sale at any time.
2.3 Pricing
All prices are displayed in Euros and are inclusive of any applicable taxes. Prices do not include shipping costs. The Seller is not currently registered for VAT (TVA) and sales are made under the franchise en base de TVA regime in accordance with Article 293 B of the French General Tax Code (CGI).
2.4 Orders
Orders are placed via the website checkout process. The Customer is responsible for verifying the accuracy of all information entered at the time of ordering. An order confirmation will be sent to the email address provided following successful payment. The Seller reserves the right to refuse or cancel any order in the event of a pricing error, unavailability, or any other legitimate reason.
2.5 Payment
Payment is required in full at the time of ordering. Payments are processed via Stripe. The Seller does not store or have access to the Customer's payment card details.
2.6 Production and Fulfilment
All prints are produced and fulfilled by theprintspace (Printspace Studios Limited, 74 Kingsland Road, London, E2 8DL, United Kingdom) via their creativehub platform. Production is initiated the business day following receipt of the order and typically takes 2-5 business days.
2.7 Delivery
Estimated delivery times from dispatch: 6-10 working days within Europe, 6-15 working days for the rest of the world. Customs duties and import taxes are the sole responsibility of the Customer. Risk of loss or damage passes to the Customer upon delivery.
2.8 Right of Withdrawal
All prints sold on this website are produced to order and are exempt from the 14-day right of withdrawal in accordance with Article L221-28 of the French Consumer Code. The Customer is informed of this exemption at the cart and checkout stages prior to completing their purchase.
2.9 Damaged or Lost Orders
In the event that a print arrives damaged, the Customer must contact info@deaghanimagery.com within 48 hours of delivery with photographs of the damage, packaging, and shipping label. The remedy is replacement only. In the event of a lost order, the Seller will arrange for a replacement at no additional cost.
2.10 Intellectual Property
All images displayed on this website are the exclusive intellectual property of Déaghán Ó Dálaigh. The purchase of a print confers a right to display the physical print for personal, non-commercial use only.
2.11 Applicable Law and Disputes
These CGV are governed by French law. Consumers may contact the European Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
3. Privacy Policy
The data controller is Déaghán Ó Dálaigh, contactable at info@deaghanimagery.com. This privacy policy is provided in accordance with GDPR and French Law No. 78-17 of 6 January 1978. Personal data collected includes identification data, delivery data, transactional data, and technical data. Data is used for order processing, legal compliance, and (with consent) mailing list communications. Order data is retained for 10 years. Data is shared only with theprintspace, Stripe, Verpex, and WooCommerce/Automattic to the extent necessary to fulfil orders.
