2. General Terms and Conditions of Sale (Conditions Générales de Vente)
2.1 Scope and Acceptance
These General Terms and Conditions of Sale (CGV) govern all sales of fine art prints made through deaghanimagery.com between Déaghán Ó Dálaigh (hereinafter "the Seller") and any natural or legal person making a purchase (hereinafter "the Customer"). Any order placed on this website constitutes full and unconditional acceptance of these CGV. The Seller reserves the right to modify these CGV at any time; the version in force at the time of order shall apply.
2.2 Products
The products offered for sale are fine art giclée prints produced on Hahnemühle Photo Rag 308gsm paper. Products are available in limited and open editions as described on the individual product listings. Edition limits stated on the website are binding; once an edition is closed it will not be reprinted at that size. All prints are made to order and do not exist as pre-produced stock. Images are reproduced as accurately as possible; however, colour rendering may vary depending on the Customer's screen calibration and cannot be guaranteed to match the Customer's display. The Seller reserves the right to withdraw any product from sale at any time.
2.3 Pricing
All prices are displayed in Euros and are inclusive of any applicable taxes. Prices do not include shipping costs, which are calculated and displayed at checkout based on the delivery destination. The Seller is not currently registered for VAT (TVA) and sales are made under the franchise en base de TVA regime in accordance with Article 293 B of the French General Tax Code (CGI). In the event that the Seller becomes VAT-registered, prices and invoicing will be updated accordingly and customers will be informed. The Seller reserves the right to modify prices at any time. The price applicable to any order is the price displayed at the time the order is placed.
2.4 Orders
Orders are placed via the website checkout process. The Customer is responsible for verifying the accuracy of all information entered at the time of ordering, including delivery address, product selection, and size. The Seller cannot be held responsible for errors made by the Customer in the order process. An order confirmation will be sent to the email address provided by the Customer following successful payment. This confirmation constitutes acceptance of the order by the Seller. The Seller reserves the right to refuse or cancel any order in the event of a pricing error, unavailability of the product, suspicion of fraudulent activity, or any other legitimate reason.
2.5 Payment
Payment is required in full at the time of ordering. Accepted payment methods are displayed at checkout and are processed via Stripe, a secure third-party payment provider. The Seller does not store or have access to the Customer's payment card details. All transactions are encrypted and processed in accordance with applicable security standards. The order will not be processed until payment has been confirmed.
2.6 Production and Fulfilment
All prints are produced and fulfilled by theprintspace (Printspace Studios Limited, 74 Kingsland Road, London, E2 8DL, United Kingdom) via their creativehub platform. The Seller acts as the seller of record; theprintspace acts as the print producer and fulfilment partner. Production is initiated the business day following receipt of the order. Production typically takes 2–5 business days. The Seller has no direct control over the production process and cannot guarantee production times in the event of circumstances beyond its control, including but not limited to equipment failure, material shortages, or force majeure events.
2.7 Delivery
Delivery is carried out by theprintspace using third-party courier services. Estimated delivery times from dispatch are 6–10 working days within Europe and 6–15 working days for the rest of the world. These are estimates provided on a best-endeavour basis and are not contractual commitments. The Seller cannot be held liable for delays caused by courier services, customs procedures, incorrect addresses provided by the Customer, or any other circumstance outside the Seller's control. Customs duties and import taxes applicable in the Customer's country are the sole responsibility of the Customer. Tracking information will be provided where available. Risk of loss or damage passes to the Customer upon delivery.
2.8 Right of Withdrawal
Under European Union Directive 2011/83/EU on consumer rights, as transposed into French law, consumers ordinarily have a 14-day right of withdrawal from distance contracts. However, this right does not apply to goods that are clearly personalised or made to the consumer's specifications. All prints sold on this website are produced to order and are therefore exempt from the right of withdrawal in accordance with Article L221-28 of the French Consumer Code. The Customer is informed of this exemption at the cart and checkout stages prior to completing their purchase. The Customer acknowledges and accepts this condition by placing an order.
2.9 Damaged or Lost Orders
In the event that a print arrives damaged, the Customer must contact the Seller at info@deaghanimagery.com within 48 hours of delivery. The notification must include clear photographs of the damage to the print, the packaging, and the shipping label. Failure to notify within this period may result in the claim being declined. Upon receipt and assessment of the evidence, the Seller will arrange for a replacement print to be produced and dispatched at no additional cost to the Customer. No cash refund will be offered for damaged prints; the remedy is replacement only. In the event that an order is confirmed as lost in transit, the Seller will arrange for a replacement at no additional cost. The Seller's liability in all cases is limited to the replacement of the product and does not extend to any indirect, consequential, or incidental losses.
2.10 Defective Products
The Seller warrants that products conform to their description at the time of sale. In the event of a manufacturing defect, the Customer should contact the Seller within 48 hours of delivery with photographic evidence. The remedy for a confirmed manufacturing defect is replacement. The Seller's obligations under this clause are in addition to, and do not affect, the Customer's statutory rights under applicable consumer protection legislation, including the legal guarantee of conformity (garantie légale de conformité) under Articles L217-4 to L217-14 of the French Consumer Code and the guarantee against hidden defects (garantie des vices cachés) under Articles 1641 to 1649 of the French Civil Code.
2.11 Intellectual Property
All images, photographs, and artistic works displayed on this website are the exclusive intellectual property of Déaghán Ó Dálaigh and are protected under French and international copyright law. The purchase of a print confers on the Customer a right to display the purchased physical print for personal, non-commercial use only. No reproduction, distribution, publication, modification, or commercial use of any image or work displayed on this website is permitted without the prior written consent of the Seller. Any unauthorised use constitutes an infringement of copyright and will be pursued accordingly.
2.12 Limited Editions
Where a print is offered as a limited edition, the edition limit stated on the website is the total number of prints of that image at that size that will ever be produced by the Seller. Edition numbers are managed by theprintspace via the creativehub platform. The Seller takes reasonable steps to ensure accuracy of edition tracking but cannot be held liable for minor administrative discrepancies resulting from the third-party fulfilment system. Open edition prints carry no such limit and may be produced indefinitely.
2.13 Applicable Law and Disputes
These CGV are governed by French law. In the event of a dispute, the Customer is encouraged to contact the Seller directly at info@deaghanimagery.com in the first instance. In the absence of an amicable resolution, the Customer may have recourse to a consumer mediator. In accordance with Article L612-1 of the French Consumer Code, the Seller is required to inform the Customer of the existence of a mediation service. Consumers may contact the European Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. In the event that mediation fails, disputes shall be subject to the jurisdiction of the competent French courts.
3. Privacy Policy (Politique de Confidentialité)
3.1 Data Controller
The data controller for personal data collected via this website is Déaghán Ó Dálaigh, contactable at info@deaghanimagery.com. This privacy policy is provided in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (the General Data Protection Regulation, GDPR) and French Law No. 78-17 of 6 January 1978 (Loi Informatique et Libertés).

3.3 Purposes and Legal Basis
Personal data is collected and processed for the following purposes: processing and fulfilling orders (legal basis: performance of a contract); communicating with customers regarding their orders (legal basis: performance of a contract); complying with legal and accounting obligations (legal basis: legal obligation); sending occasional communications to customers who have subscribed to the mailing list (legal basis: consent, which may be withdrawn at any time); improving the website and understanding visitor behaviour (legal basis: legitimate interest).
3.4 Data Retention
Order-related personal data is retained for a period of 10 years in accordance with French accounting and commercial law requirements. Email addresses collected via subscription are retained until consent is withdrawn. Technical data collected via server logs is retained for a maximum of 12 months.

The Seller does not sell, rent, or otherwise transfer personal data to third parties for marketing or any other purpose. Data may be disclosed to competent authorities where required by law.
3.6 Data Subject Rights
In accordance with GDPR, the Customer has the following rights in respect of their personal data: the right to access; the right to rectification; the right to erasure (subject to legal retention obligations); the right to restriction of processing; the right to data portability; the right to object to processing based on legitimate interests. To exercise any of these rights, the Customer should contact the Seller at info@deaghanimagery.com. The Customer also has the right to lodge a complaint with the Commission Nationale de l'Informatique et des Libertés (CNIL) at www.cnil.fr.
3.7 Security
The Seller takes reasonable technical and organisational measures to protect personal data against unauthorised access, loss, or disclosure. However, no transmission over the internet can be guaranteed to be completely secure and the Seller cannot guarantee the absolute security of data transmitted to this website.
